HIPAA Privacy Policy

This Privacy Policy explains how Beachn Behavior LLC (“the Practice”) collects, uses, discloses, and protects your Protected Health Information (PHI) in accordance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and all applicable privacy regulations.
Your Protected Health Information: Protected Health Information (PHI) refers to any information that identifies you or your child and relates to your or your child’s past, present, or future physical or mental health, the care provided, or payment for that care. Examples include names, addresses, birth dates, session notes, intake forms, videos, and consultation records.
How Your Information Is Used: Beachn Behavior LLC may use and disclose PHI for the following purposes:
Service Delivery: To provide parent consultation, education, and behavioral guidance services.
Administrative Operations: For scheduling, billing, record-keeping, quality improvement, and internal audits.
Payment Processing: To process payment for services rendered through HIPAA-compliant systems.
Legal Requirements: To comply with laws, court orders, or government requests when required.
Client Communication: To send appointment reminders, respond to inquiries, or provide relevant follow-up materials through secure channels.
Confidentiality and Security: Beachn Behavior LLC maintains administrative, physical, and technical safeguards to protect your PHI, including:
Encryption of electronic communications containing PHI.
Use of HIPAA-compliant platforms for video sessions, intake forms, scheduling, and file storage.
Password-protected devices and accounts.
Limited access to client information to authorized personnel only.
Secure disposal of physical and electronic records according to legal retention standards.
Your Rights: As a client or guardian, you have the right to:
Request to see or receive a copy of your records.
Request corrections to inaccurate or incomplete information.
Receive an accounting of disclosures (who has accessed your PHI).
Request that Beachn Behavior limit or restrict certain uses or disclosures (where legally permitted).
Request confidential communications through specific methods or contact information.
Receive a paper or electronic copy of this policy at any time.
All requests must be submitted in writing to the Privacy Officer listed below.

Electronic Communication: Beachn Behavior LLC may communicate via email or telehealth platforms. Only HIPAA-compliant systems will be used for any communication containing PHI. Non-secure methods will not be used to share sensitive information without your written consent and acknowledgment of potential risks.
Data Retention: Records and documentation are maintained for a minimum of seven (7) years from the date of the last service or as required by Virginia state law. After this period, all records are securely destroyed.
